1. Introduction

Welcome to TicketStockMarket.in (the "Platform"). These Affiliate Terms & Conditions ("Terms") govern your relationship with us as an Affiliate Partner (also referred to as "you" or "your") participating in our Affiliate Program. By registering as an Affiliate and using our services, you agree to be bound by these Terms.

These Terms are in addition to our general Terms of Service and Privacy Policy. In the event of any conflict, these Affiliate Terms shall prevail with respect to your affiliate activities.

2. Affiliate Eligibility

To register as an Affiliate on the Platform, you must:

• Be at least 18 years of age
• Provide accurate, complete, and up-to-date information during registration
• Have a valid email address and phone number
• Have a website, blog, social media presence, or other promotional channels
• Not be listed on any government sanctions or restricted parties list
• Not have been previously banned from our Affiliate Program

We reserve the right to approve or reject any affiliate application at our sole discretion.

3. Affiliate Account

As an Affiliate, you are responsible for:

• Maintaining accurate and up-to-date profile information
• Keeping your account credentials secure and confidential
• Immediately notifying us of any unauthorized access to your account
• Regularly checking your affiliate dashboard for performance updates
• Ensuring your promotional methods comply with these Terms

4. Commission Structure

As an Affiliate, you earn commissions on successful ticket sales made through your unique affiliate links. The commission structure is as follows:

Commission Calculation:

• Commission is calculated on the total ticket price (excluding taxes, service fees, and payment processing fees)
• Commission is earned only when the ticket sale is completedand confirmed by the customer
• Commission is not earned on:
  • Refunded or cancelled tickets
  • Chargeback transactions
  • Fake or fraudulent purchases
  • Purchases made by the affiliate themselves

5. Affiliate Links & Tracking

We provide you with unique affiliate links to track your referrals:

• Unique Links: Each affiliate receives unique tracking links for different events, categories, or general Platform promotion
• Cookie Duration: Customer activity is tracked for 30 days from the first click. If a customer makes a purchase within this period, you earn the commission
• Real-Time Analytics: Your dashboard shows real-time data on clicks, conversions, and earnings
• Multiple Platforms: You can promote your links through websites, blogs, social media, email, and other legitimate channels
• Link Integrity: You must not modify, manipulate, or tamper with affiliate links in any way

6. Payouts

We process affiliate payouts as follows:

• Payout Period: Commissions are paid monthly, typically within 15 business days after the end of each calendar month
• Vesting Period: Commission earnings are held for 30 days after the event ends to account for any potential refunds or chargebacks
• Payout Amount: The payout amount equals the total earned commissions minus:
  • Any chargebacks or refunds
  • Any applicable taxes (if required by law)
  • Any fees for payment processing
• Payout Method: Payouts are made via your selected payment method (bank transfer, PayPal, etc.) as specified in your affiliate profile
• Minimum Payout: The minimum payout threshold is $50. If your balance is below this amount, it will be carried forward to the next month

7. Prohibited Promotional Methods

To maintain the integrity of our Affiliate Program, the following promotional methods are strictly prohibited:

• Spam: Sending unsolicited emails, messages, or any form of spam promoting the Platform
• Misleading Advertising: Making false or misleading claims about the Platform, events, or ticket prices
• Copywriting Violations: Copying or using copyrighted content without permission
• Fake Reviews: Posting fake reviews or testimonials about the Platform or events
• Cookie Stuffing: Using any technique to artificially inflate clicks or commissions
• Self-Referrals: Creating multiple accounts or purchasing tickets for yourself to earn commissions
• Bots & Automation: Using automated software, bots, or scripts to generate clicks or traffic
• Incentivized Clicks: Offering rewards, cash, or incentives to encourage clicks on affiliate links
• Domain Squatting: Using domain names that are similar to our brand or trademark
• Framing: Embedding our Platform in frames or iframes without proper attribution

8. Allowed Promotional Methods

We encourage creative and ethical promotion of the Platform. Allowed promotional methods include:

• Content Marketing: Creating blog posts, articles, or videos about events and the Platform
• Social Media: Sharing affiliate links on personal or business social media accounts
• Email Marketing: Sending promotional emails to your existing subscribers who have opted in
• Influencer Marketing: Collaborating with influencers to promote events
• Forums & Communities: Sharing relevant links in online communities, provided it adds value and follows community rules
• Paid Advertising: Using PPC ads, social media ads, or other paid channels with proper disclosure

All promotional activities must clearly disclose that you are an affiliate and may earn commissions from sales.

9. Fraud & Misconduct

We take fraud and misconduct seriously. The following activities are considered fraudulent and will result in immediate action:

• Creating fake accounts or using bots to generate artificial clicks or sales
• Using stolen credit cards or fraudulent payment methods
• Promoting the Platform in illegal or unethical ways
• Attempting to hack, reverse-engineer, or exploit the Platform
• Submitting false information or impersonating others
• Engaging in any activity that damages our brand reputation

If we suspect fraud or misconduct, we reserve the right to:

• Withhold commissions for investigation
• Terminate your affiliate account immediately
• Forfeit all earned and unpaid commissions
• Report fraudulent activities to law enforcement authorities
• Pursue legal action to recover damages

10. Intellectual Property

As an Affiliate, you are granted a limited, non-exclusive, revocable license to:

• Use our brand name, logo, and promotional materials provided by us
• Promote the Platform using approved marketing collateral

You may not:

• Modify our brand assets without written permission
• Use our brand in a way that damages our reputation
• Register domain names containing our trademarks
• Copy or reproduce any content from our Platform without permission

11. Termination

We reserve the right to terminate your affiliate account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Misrepresentation of the Platform
• Negative impact on our brand reputation
• Inactivity for 12 months or more
• Any other conduct we deem inappropriate

Upon termination, you will lose access to your affiliate dashboard and will not earn commissions on future referrals. Any outstanding commissions earned prior to termination (subject to the vesting period) will be paid out if they meet the minimum threshold.

12. Taxes & Compliance

As an Affiliate, you acknowledge and agree that:

• You are responsible for reporting and paying all applicable taxes on your commission earnings to the appropriate tax authorities
• We may be required to report your commission earnings to tax authorities in certain jurisdictions
• You must provide us with any tax-related documentation we reasonably request (e.g., W-9, W-8BEN, VAT registration, tax identification number)
• You must comply with all applicable laws, including consumer protection, advertising, and privacy regulations

13. Limitation of Liability

The Platform is provided "as is" and we make no warranties regarding its availability, reliability, or performance. We are not liable for any direct, indirect, incidental, or consequential damages arising from your participation in the Affiliate Program, including but not limited to lost revenue, lost profits, or data loss.

Our total liability to you shall not exceed the total commissions we have paid to you in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your promotional activities, violation of these Terms, or any infringement of third-party rights.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TicketStockMarket.in operates, without regard to its conflict of law provisions.

16. Changes to Terms

We reserve the right to update or modify these Terms at any time. We will provide at least 30 days' notice for material changes. Your continued participation in the Affiliate Program after the changes become effective constitutes your acceptance of the revised Terms.
